Divorce In Islam
Allah Almighty has used the word of “Nikkah” to unite a man and a woman in a relationship. In this beautiful religious bound both make each other complete, and form a family. The contract of Nikkah is the mutual consent meant of both husband and wife. In a verse of Holy Quran Allah (SWT) says.
They ( your wives) are your clothing ( covering) and you too are a ( covering) for them.
A married couple has some duties upon each other. It is a husband’s duty to fulfil the needs of his wife happily, though her husband has more rights over her. Men are asked to treat their wives kindly and with love. But if a husband and wife are unable to lead a happy life and their relationship is not working out then unfortunately the matrimonial contract is broken. Divorce is one of the way to dissolve the contract. Though Islam considers divorce des testable of all the lawful acts. The Holy prophet Hazrat Muhammad (saw) has also declared divorce a worst decision.
He said,
“Divorce is the most hated of permissible things to Allah”.
But in some cases this becomes the necessity. Although it is strongly discouraged in Islam but as a last resort it is permitted. There are certain obligatory conditions that are considered for a valid divorce. For example in the state of menstruation, divorce is invalid, or when a woman is pregnant divorce can not be accepted. Even the words that are uttered those are also considerable.
A person should be sane enough to take a decision. After divorce it is compulsory for a woman to wait for complete three lunar months from the time of divorce. It is called (Iddah) during this time she observes seclusion.
There are two types of divorce, Irrecoverable and recoverable divorce but in accordance with the teachings of Quran these two types have further more conditions to make it valid. Quran gives us a detailed insight and knowledge of this matter in different surahs. A person who divorces his wife he can re-conciliate within a certain period of time according to the rules and regulations of Holy Quran. And a divorced woman is allowed to get married again after Iddah.
